
FieldJot Terms of Use

These terms cover your use of the FieldJot Android app. Please read them — particularly the section on what a FieldJot report is and isn't.
1. Who publishes FieldJot
FieldJot (FieldJot: Daily Site Reports, Android package com.cmmmstudios.sitelog) is published by CMMM Studios, a product studio based in Los Angeles, California, United States. In these terms, “we” and “us” mean CMMM Studios, and “you” means the person or business using the app.
2. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable licence to install and use FieldJot on devices you control, for your own personal or business purposes.
You are licensed to use the app; you do not acquire ownership of it. CMMM Studios retains all rights in the FieldJot software, name, and design. You may not sell, sublicense, rent, or redistribute the app, and you may not reverse-engineer, decompile, or attempt to derive its source code except to the extent that restriction is unenforceable under applicable law.
Your content stays yours. The reports, photos, and captions you create in FieldJot belong to you. They stay on your device — we receive no copy and claim no rights in them.
3. Your responsibilities
You are responsible for how you use FieldJot. In particular:
- Accuracy. The content of every report is entered by you. You are responsible for whether it is accurate, complete, and honest.
- Permission to photograph. You are responsible for having the right to photograph a jobsite, its occupants, and its contents, and for complying with any site rules, client agreements, or confidentiality obligations that apply.
- Personal and confidential information. If your reports contain personal information about workers, clients, or members of the public, you are responsible for handling and sharing it lawfully. You decide who receives an exported PDF.
- Keeping your own copies. Retaining the records you need is your responsibility — see section 5.
- Lawful use. Don't use FieldJot to break the law or to infringe anyone else's rights.
4. What a FieldJot report is not
FieldJot is a documentation tool. It produces a record of what you entered — nothing more.
We do not guarantee that a report generated with FieldJot satisfies any contractual, building-code, inspection, permitting, insurance, evidentiary, regulatory, or other legal requirement. Requirements differ by jurisdiction, contract, trade, and circumstance, and they change. Whether a given report meets a given requirement is for you — and where it matters, your lawyer, insurer, or the relevant authority — to determine. Do not treat FieldJot output as legal, professional, or compliance advice.
5. Data and loss
FieldJot keeps your reports and photos in its private storage on your device. We do not receive a copy.
This means that uninstalling the app, clearing its data, resetting or replacing the device, device failure, or loss or theft of the device will remove your reports and photos. We cannot recover them under any circumstances, because we never receive them. Export and store the PDFs you need to keep.
6. Purchase, pricing, and refunds
FieldJot is distributed through Google Play. Any purchase, the price you are charged, applicable taxes, payment processing, and refunds are handled by Google under Google Play's own terms and policies, not by us.
Prices shown on this website are indicative and may differ from the final price Google Play displays in your country. Requests for refunds should be directed to Google Play in the first instance, subject to its refund policy. Your access to the app depends on your Google Play purchase remaining in good standing.
7. Availability and changes to the app
We may update FieldJot to fix problems, improve it, or keep it working with new versions of Android. Features may change over time.
We do not promise that the app will remain available indefinitely, that it will be compatible with every current or future device or Android version, or that it will be free of defects or interruptions. Continued distribution through Google Play is also subject to Google's policies and decisions.
8. Disclaimer of warranties
To the fullest extent permitted by law, FieldJot is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply to you only to the extent permitted, and nothing in these terms limits rights you have under mandatory consumer protection law.
9. Limitation of liability
To the fullest extent permitted by law, CMMM Studios will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, lost business, lost data, or the cost of reconstructing lost reports, arising out of or relating to your use of FieldJot.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to FieldJot will not exceed the amount you actually paid for the app.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.
10. Termination
You may stop using FieldJot at any time by uninstalling it. Your licence ends automatically if you materially breach these terms.
Sections 4, 5, 8, 9, and 11 continue to apply after your licence ends.
11. Changes to these terms
We may update these terms. When we do, we will change the “last updated” date at the top of this page, and the current version will always be published at cmmmstudios.com/fieldjot/terms. Continuing to use the app after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, except where mandatory law in your place of residence requires otherwise.
